Motor Vehicle Claims

Instructions on filing insurance claims for tort claims (damage to personal property) and vehicular claims (State vehicles involved in a motor vehicle accidents) is available on this page. To file a claim involving a State building contact us at (301) 405-3964.

New Claims Procedures began July 1, 1999. These changes effect the first party loss recovery program.


Insurance
Insurance and tort claims are investigated and processed. Reports of bodily injury and property damage are documented.

Facts You Should Know if You Were Driving a State Vehicle Involved in a Motor Vehicle Accident

  • Refer to the instructions on filing a claim if you were driving a State vehicle involved in a Motor Vehicle Accident
  • "What to Do in Case of an Auto Accident" pamphlet should be in all State vehicles. This pamphlet includes a form that should be used to report accidents involving a State vehicle.
  • If you are found to be at fault in an accident, a $150.00 processing fee will be charged to your department regardless of how minor the damage is.
  • When you fail to enter all information in your "What To Do In Case of An Auto Accident" pamphlet (located in each vehicle), the report will be incomplete and will delay the claim being processed in a timely manner. Upon receiving your report, the Department of Environmental Safety Insurance Coordinator must submit a claim to the State Treasurer's Office within 24-hours.
  • You must report ALL auto accidents regardless of how minor the damage is.
  • Vehicles must be repaired after an accident unless the department plans to scrap or sale the vehicle.
  • You should always check the vehicle before you get in it. If there is damage that was not there before, report it to your supervisor.
  • Damage to the inside of the vehicle (cigarette burns, holes in upholstery, damage to steering wheels, etc.) should be reported before you use the vehicle. Your department could charge you for damages.
  • State vehicles are to be used for University business only. If you have an accident while using a State vehicle for other than University business, the driver will be responsible for all damages to the State vehicle and any other damages incurred.
  • University Driving Rules

The University of Maryland expects their property to be utilized with care and respect. Please try to use caution and eliminate unnecessary accidents.


Tort Claims

  1. Damage to personal property is covered, but an estimate and list must be sent to the State Treasury Office.
  2. Theft is not covered under any circumstance.
  3. Individuals who wish to file a tort claim should read the Instructions for the Notice of Claim and then fill out a Notice of Claim  (available in Display PDF Form or Display Word).
  4. Departments are not allowed to buy their own insurance for coverage for theft (Personal or State property). Departments should take precautions to secure their property.

Risks and Liabilities of Automobile Use within the Scope of Public Duties


Tenants and Users Liability Insurance Policy (TULIP)

The University of Maryland requires all organizations/users who host events or programs on campus for a non-University of Maryland event, be insured for liability. Users must provide evidence of such coverage (certificate of insurance) to the office booking your event and to the Department of Environmental Safety-Risk Management Office two weeks prior to the event. This requirement can be satisfied by purchasing a general liability policy or by providing a certificate of insurance.

The TULIP is a Tenants' and Users' Liability Insurance Policy, also known as "Events Coverage". It is used by institutions who permit "third parties" to use their facilities for specific events. It protects both the Facility User and the Institution against claims by third parties who may be injured or lose property as a result of participating in an event. Events may range from very low risk events such as classroom seminars, receptions or weddings to higher risk events including camps, sports events or rock concerts.

  • Within 24 hours, a State vehicle accident must be reported to the Department of Environmental Safety Insurance Coordinator, (301) 405-3964. You may fax the report at (301) 405-2391 or deliver the form in person. The pamphlet/form "What to Do in Case of an Auto Accident" may be found in the glove box of all State vehicles. Your supervisor must review and sign the form before it is delivered to DES.

  • Individuals who wish to file a tort claim should read the Instructions for the Notice of Claim and then fill out a Notice of Claim  (available in Display PDF Form or Display WordPerfect).
